Terms & Conditions
1. Overview
By engaging in services with Permian Scholars Tutoring ("the Company"), clients acknowledge that they have read, understood, and agreed to the following Terms and Conditions. These terms are designed to ensure a clear, professional, and mutually beneficial relationship between the Company and its clients.
2. Booking and Scheduling
All tutoring sessions must be requested through the Company’s official booking system or by phone call, email, and, in some instances, text message. A session is not considered confirmed until it has been reviewed and approved by the Company. The Company reserves the right to deny or modify any booking request based on tutor availability and scheduling constraints. Clients who enroll in recurring sessions may receive priority scheduling and reserved time slots.
3. Payment Terms
All tutoring sessions must be paid for in advance in order to secure the scheduled time. Failure to submit payment by the designated deadline may result in suspension or cancellation of services. The Company also reserves the right to deny future bookings for any outstanding balances.
4. Pricing and Rate Policies
The standard rate for tutoring services is $35 per hour unless otherwise specified. Discounted rates, including “Founding Family” rates, are offered at the Company’s discretion and are not guaranteed indefinitely. These rates are contingent upon maintaining a consistent weekly schedule and adherence to Company policies. The Company reserves the right to modify pricing with reasonable notice.
5. Minimum Commitment
Clients participating in recurring tutoring services are required to maintain a minimum of four sessions per month. Failure to meet this minimum requirement may result in the loss of any discounted or promotional rates.
6. Cancellations and Rescheduling
Clients must provide at least 24 hours’ notice for any cancellation or request to reschedule a session. Cancellations made with less than 24 hours’ notice will be charged 60% the original rate. Clients who fail to attend a scheduled session without notice (no-show) will be charged in full. At the Company’s discretion, recurring clients may be granted one rescheduled session per month per student as a courtesy.
7. Late Arrivals
Tutors will wait up to 10 minutes after the scheduled start time for a student to arrive. If a student arrives late, the session will still conclude at the originally scheduled time. If a tutor arrives late, the session time will be extended or otherwise adjusted to compensate for the delay.
8. Refund Policy
All completed tutoring sessions are non-refundable. Prepaid sessions are also non-refundable; however, in certain circumstances, the Company may issue a credit at its sole discretion. Any refund requests will be evaluated on a case-by-case basis and are not guaranteed.
9. Session Expiration
All prepaid sessions must be used within 30 days of purchase unless otherwise agreed upon in writing. Any unused sessions after this period will be considered forfeited and are not eligible for refund.
10. Tutor Assignment
The Company assigns tutors based on student needs, subject expertise, and availability. While client preferences may be considered, the Company does not guarantee the availability of any specific tutor. The Company reserves the right to reassign or substitute tutors as necessary.
11. Independent Contractor Status
All tutors engaged by the Company operate as independent contractors. They are not employees of the Company. The Company is not liable for any actions or conduct of tutors outside the scope of scheduled tutoring services.
12. Client Responsibilities
Clients are responsible for ensuring that students are present, prepared, and ready to participate at the scheduled session time. Clients must also provide an appropriate and distraction-free environment conducive to learning. Clear communication regarding academic goals and expectations is encouraged.
13. Code of Conduct
All clients, students, and tutors are expected to engage in respectful and professional behavior at all times. Any form of harassment, discrimination, or inappropriate conduct may result in immediate termination of services without refund.
14. Academic Disclaimer
Permian Scholars Tutoring provides supplemental educational support and does not guarantee specific academic outcomes, including grades or test scores. Student success depends on multiple factors, including participation, effort, and external academic environments.
15. Limitation of Liability
The Company shall not be held liable for any indirect, incidental, or consequential damages arising from tutoring services. In all cases, the Company’s total liability shall not exceed the amount paid by the client for services rendered.
16. Termination of Services
Either the client or the Company may terminate tutoring services with written notice, unless outlined otherwise by package deals. The Company reserves the right to terminate services immediately if any policies are violated.
17. Referral Program
Referral credits will be applied only after the referred client has completed and paid for their first session. Credits are non-transferable, have no cash value, and may only be applied toward future tutoring sessions.
18. Force Majeure
The Company shall not be held responsible for delays or cancellations caused by events beyond its control, including but not limited to illness, severe weather, technical failures, or other unforeseen circumstances.
19. Privacy
The Company respects client privacy and will only use personal information for business operations.
20. Agreement
By booking or participating in tutoring services, the client acknowledges that they have read, understood, and agreed to these Terms and Conditions in full.
